2. Description of Service

ExamReady.ai is an AI-powered exam preparation platform that allows students to:

• Practice questions from official GCSE and A-Level past papers
• Submit answers for AI-powered marking and feedback
• Track progress across subjects and topics
• Access official exam board PDFs

Educational Purpose: The Service is designed for educational and practice purposes only. It is not a substitute for formal education, teacher instruction, or official examination.

3. AI Marking Disclaimers

By using our AI marking feature, you acknowledge and agree that:

• Not Official Assessment: AI-generated feedback is not an official mark, grade, or assessment. Only qualified examiners appointed by exam boards can provide official marks.
• No Guarantee of Accuracy: While our AI is trained to follow mark schemes, it may make errors, miss nuances, or interpret answers differently than human examiners would.
• Educational Tool Only: AI feedback is intended to help you practice and improve. It should not be relied upon as a definitive assessment of your abilities or likely exam performance.
• Not Endorsed by Exam Boards: ExamReady.ai is not affiliated with, endorsed by, or sponsored by WJEC, AQA, Edexcel, OCR, or any other examination board. Exam boards do not validate or approve our AI marking.
• AI Limitations: AI technology has inherent limitations. It may struggle with creative answers, unconventional approaches, diagrams, handwriting recognition, or subject-specific terminology.
• User Responsibility: You are responsible for verifying AI feedback against official mark schemes and seeking guidance from qualified teachers or tutors when needed.
• No Substitute for Teachers: AI feedback does not replace the expertise, judgment, and personalized guidance of qualified teachers and educators.

Use at Your Own Risk: You use AI marking feedback at your own risk and should not rely solely on it for exam preparation or to assess your readiness for examination.

4. User Accounts

4.1 Account Creation

• You must create an account to use our Service
• We use OAuth authentication only (Google, Microsoft, or Apple)
• You must provide accurate and complete information
• You must be at least 13 years old to create an account (parental consent required for users under 13)

4.2 Account Security

• You are responsible for maintaining the security of your account
• You must not share your account with others
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account

4.3 One Account Per Person

Each person may only create and maintain one account. Creating multiple accounts to circumvent usage limits or restrictions is prohibited.

5. Acceptable Use

5.1 Permitted Use

You may use the Service for personal, non-commercial educational purposes to prepare for GCSE and A-Level examinations.

5.2 Prohibited Activities

You must not:

• Use the Service during actual examinations or assessments
• Use the Service for commercial purposes without authorization
• Scrape, data-mine, or use automated tools to access the Service
• Attempt to reverse engineer, decompile, or discover source code
• Circumvent any access controls, rate limits, or restrictions
• Upload malicious code, viruses, or harmful content
• Impersonate others or misrepresent your identity
• Share, resell, or redistribute content from the Service
• Attempt to gain unauthorized access to any systems or data
• Use the Service to violate any laws or regulations
• Interfere with or disrupt the Service or servers
• Submit answers generated by other AI tools and claim them as your own work

6. Intellectual Property

6.1 Exam Board Content

Past paper questions, mark schemes, and specifications remain the intellectual property of their respective exam boards (WJEC, AQA, Edexcel, OCR, etc.). We provide links to official exam board PDFs but do not host or claim ownership of this content.

6.2 Platform Content

The ExamReady.ai platform, including our website, software, design, text, graphics, user interface, and all related intellectual property, is owned by us and protected by copyright, trademark, and other laws.

6.3 User-Generated Content

You retain ownership of answers you submit. However, by submitting content to our Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Process your answers through our AI marking system
• Store your answers and feedback in our database
• Use aggregated, anonymized data for service improvement

7. Limitation of Liability

7.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• AI marking will be accurate, complete, or reliable
• The Service will meet your specific requirements
• Defects will be corrected
• The Service is free from viruses or harmful components

7.2 No Liability for AI Errors

WE ARE NOT LIABLE FOR:

• Inaccurate or incorrect AI marking feedback
• Misinterpretation of answers by AI
• Differences between AI feedback and official examiner marking
• Reliance on AI feedback for exam preparation
• Any academic outcomes, exam results, or grades

7.3 No Liability for Outcomes

WE ARE NOT RESPONSIBLE FOR:

• Your exam results or academic performance
• Educational decisions made based on the Service
• Missed educational opportunities
• Incorrect or outdated exam board content
• Differences between practice questions and actual exams

7.4 Limited Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF:

• £100 (one hundred pounds sterling), OR
• The amount you paid us in the 12 months before the claim arose

7.5 Exclusion of Consequential Damages

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

8. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranties regarding accuracy, reliability, or completeness of AI feedback
• Any warranties that the Service will improve your exam performance
• Any warranties regarding availability or uptime

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. You may have other rights that vary by jurisdiction.

9. Indemnification

You agree to indemnify, defend, and hold harmless ExamReady.ai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service
• Your reliance on AI feedback

10. Service Availability and Changes

10.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or server problems
• Third-party service disruptions
• Force majeure events

10.2 Changes to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability. This includes features, content, pricing, and AI capabilities.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at hello@examready.ai. Upon termination, your access will cease and your data will be deleted according to our Privacy Policy.

11.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms
• You engage in prohibited activities
• Your account is inactive for an extended period
• We discontinue the Service
• Required by law or legal process

11.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

12. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
